Form 1099-NEC reports what you paid a non-employee for services. Form 1099-MISC reports most other payments: rent, royalties, prizes and other income, medical payments and gross proceeds paid to an attorney. For 2026 payments the main boxes on both forms use a $2,000 threshold; attorney gross proceeds use $600 and royalties $10. Form 1099-NEC is due February 1, 2027; Form 1099-MISC is due March 1 on paper or March 31 electronically.

Key takeaways

  • Contractor fees, including a law firm’s fees for its own services, go on 1099-NEC box 1a. Settlement proceeds paid to an attorney go on 1099-MISC box 10.
  • On Form 1099-MISC, rents are box 1, royalties box 2, prizes and other income box 3, medical and health care payments box 6.
  • The 2026 forms add boxes for cash tips and overtime (NEC 1b to 1d; MISC 13a, 13b and 14) and move nonemployee compensation to box 1a.
  • 1099-NEC goes to the IRS and recipients by February 1, 2027. 1099-MISC recipient copies are due February 1 (February 16 for boxes 8 and 10); the IRS copy March 1 on paper or March 31 e-filed.
  • Corrections go through IRIS: one step for a wrong amount, name or TIN, two steps when the wrong form type was filed.

The short answer: services on NEC, almost everything else on MISC

The split is about what the money was for. If you paid someone who is not your employee for work they did, the payment is nonemployee compensation and belongs on Form 1099-NEC, box 1a. Everything else that §6041 makes reportable, rent, royalties, prizes, medical payments, settlement proceeds routed through a lawyer, goes on Form 1099-MISC in the box that names it. The two forms share the same filer, the same payee information and the same box 4 for backup withholding; they differ in boxes and in due dates.

The 2026 revisions (Rev. December 2026) of both forms renumber several boxes, so the mapping below is for payments made in 2026 and reported in early 2027. Pull the 2026 thresholds alongside it.

Examples by payee type

  • A marketing consultant operating as an LLC taxed as a partnership bills you $9,500 for the year: 1099-NEC box 1a. Line 3a of the W-9 tells you the LLC’s classification; if it is taxed as a C or S corporation, the payment is generally exempt.
  • Your landlord, an individual, receives $36,000 of rent for your office: 1099-MISC box 1.
  • A law firm bills $4,200 for drafting contracts and, separately, receives a $150,000 settlement check for a claim against you: $4,200 in 1099-NEC box 1a and $150,000 in 1099-MISC box 10. Two forms, same firm.
  • A physician practice organized as a professional corporation is paid $18,000: 1099-MISC box 6. Medical payments are one of the exceptions to the corporate exemption.
  • A software vendor is paid $5,000 for licences: no 1099. You are paying for a product, not for services.
  • A contest winner gets a $2,500 prize: 1099-MISC box 3.
  • A part-time bookkeeper on payroll: Form W-2, never a 1099. Wages, tips and overtime paid to an employee belong on the W-2, which is also due February 1, 2027.
  • A designer paid $6,000 by credit card: no 1099-NEC from you. The card company reports it on Form 1099-K if the designer crosses $20,000 and 200 transactions.

Thresholds for 2026 payments

IRC §6041(a), as amended by P.L. 119-21 §70433, now requires a return for payments of $2,000 or more in a calendar year, effective for payments after December 31, 2025. That covers 1099-NEC box 1a and 1099-MISC boxes 1, 3 and 6. Gross proceeds paid to an attorney stay at $600 because §6045(f) was not changed, and royalties stay at $10. For 2027 and later the $2,000 amount is indexed for inflation, rounded to the nearest $100.

Box 4: backup withholding on either form

Both forms carry box 4, federal income tax withheld, and the rules behind it do not care which form you use. Publication 1281 requires 24% backup withholding when a payee does not furnish a TIN, when the IRS notifies you that the TIN is incorrect, when the IRS notifies you of underreporting, or when the payee fails to certify. For nonemployee compensation and other non-interest payments the withholding starts immediately, and any amount withheld means a return is filed for that payee regardless of the dollar threshold. A contractor who never returned a W-9 therefore gets a 1099-NEC with 24% of each payment in box 4, even if the year’s total was under $2,000. Publication 1281 also sets the solicitation schedule: an initial W-9 request when the account is opened, a first annual request by December 31 of that year and a second by December 31 of the following year.

The statutory dates are January 31 and February 28, which fall on Sundays in 2027, and February 15, which is Presidents’ Day, so each rolls to the next business day. Publication 509 for 2027 was not yet published when this guide was written. An e-filed return is timely if it is submitted through IRIS by 11:59 p.m. on the due date.

Ten or more information returns of any type, counted together, must be e-filed. From January 1, 2027, IRIS is the only IRS e-file system; FIRE closes after its last filing on November 19, 2026 at 3 p.m. Eastern.

State copies and recipient copies

Both forms are eligible for the Combined Federal/State Filing program, under which the IRS forwards the federal filing to participating states. Publication 5717 (Rev. 9-2026) lists 32 participants: AL, AZ, AR, CA, CO, CT, DC, DE, GA, HI, ID, IN, KS, LA, MA, MD, ME, MI, MN, MS, MT, NE, NJ, NM, NC, ND, OH, OK, PA, RI, SC and WI. Participation does not settle the state question, because some participating states still require direct filing, so check each state’s own rules for the forms you file.

Recipient copies can be delivered electronically only with the recipient’s affirmative electronic consent, given in a way that shows they can access the statement in that format, after a disclosure that covers the availability of a paper copy, the scope and duration of the consent, how to get a paper copy or withdraw, when statements stop, how to update information, the hardware and software needed, and how long the statement stays available (Publication 1179 §4.6 and Publication 1099 Part M). The statement must be posted by the due date, kept accessible through October 15, and the recipient notified. Without consent, mail paper.

Correcting a 1099 you already filed

Mistakes split into two kinds, and IRIS handles both. A one-step correction fixes a wrong amount, a wrong name or TIN, a wrong code or a form that should not have been filed at all. A two-step correction is for the wrong form type, for example a payment reported on Form 1099-MISC box 3 that belonged on Form 1099-NEC box 1a: the first step zeroes out the wrong form, the second files the right one. Both the IRIS Taxpayer Portal and the application-to-application (A2A) channel support corrections, including for prior years.

Speed matters because the §6721 and §6722 penalties are tiered. For returns due in 2027, a return corrected within 30 days of the due date costs $60, one corrected by August 1 costs $130, and a return corrected later or never costs $340, with the same amounts again for the payee statement. Intentional disregard is the greater of $690 or 10% of the amount. Annual caps run from $244,500 to $4,191,500 depending on the tier and on whether your receipts exceed $5 million.

Set-up that prevents the mix-up

  1. Code vendors by payment type when you onboard them, not in January. A law firm may need both forms.
  2. Collect a Form W-9 before the first payment and read line 3a: it tells you whether an LLC is taxed as a corporation.
  3. Run TIN Matching on the whole file in December, so a mismatch does not become a B-notice.
  4. Keep card and payment-app payments out of the 1099 totals.
  5. File 1099-NEC first; its February 1 deadline comes a month before the paper 1099-MISC date and two months before the electronic one.

FundTaxes’ 1099 module maps each vendor to a form and box, applies the 2026 thresholds and files and corrects through IRIS. Start a free trial.

Frequently asked questions

Is a 1099-NEC the same as a 1099-MISC?
No. Form 1099-NEC reports nonemployee compensation, which is payment to a non-employee for services. Form 1099-MISC reports other payments such as rent, royalties, prizes, medical payments and gross proceeds paid to an attorney. They have different boxes and different due dates.
Do attorneys get a 1099-NEC or a 1099-MISC?
Both, depending on the payment. Fees for the firm’s own legal services of $2,000 or more go on Form 1099-NEC box 1a. Gross proceeds paid to an attorney, such as a settlement check, of $600 or more go on Form 1099-MISC box 10.
Do I send a 1099-NEC to an LLC?
It depends on how the LLC is taxed, which line 3a of its Form W-9 shows. An LLC taxed as a partnership or a disregarded entity gets a 1099-NEC for $2,000 or more of services. An LLC taxed as a C or S corporation is generally exempt, except for the payments the instructions carve out, such as medical and attorney payments.
What if I filed a 1099-MISC but it should have been a 1099-NEC?
File a two-step correction through IRIS: the first step zeroes the 1099-MISC, the second files the 1099-NEC. A correction made within 30 days of the due date carries the lowest penalty tier, $60 per return for returns due in 2027.
When is Form 1099-NEC due for 2026?
February 1, 2027, to both the IRS and the recipient. January 31, 2027 is a Sunday. There is no automatic extension for Form 1099-NEC.
Do I need a 1099-NEC for a contractor I paid by credit card?
No. Payments made by credit card or through a third-party payment app are reported by the payment settlement entity on Form 1099-K, which applies once a payee exceeds $20,000 in payments and 200 transactions. Leave those payments off your 1099-NEC.
What is the 1099-MISC box 3 threshold for 2026?
$2,000. Box 3 (other income) follows IRC §6041(a), which P.L. 119-21 raised from $600 to $2,000 for payments made after December 31, 2025.
