# The 1099 threshold for 2026 is $2,000: what changed, which boxes kept $600 or $10, and when the forms are due

> **For payments made in 2026, you file a Form 1099-NEC or 1099-MISC when you pay a person or business $2,000 or more during the year, up from $600.** The change comes from P.L. 119-21 §70433, which amended IRC §6041(a), and it covers nonemployee compensation, rents, other income and medical payments. Gross proceeds paid to an attorney still trigger a form at $600, royalties at $10, and a return is required at any amount if you withheld federal tax.

## Key takeaways

- The $2,000 threshold applies to payments made after December 31, 2025, so the first forms it affects are the ones due in early 2027. From 2027 the amount is indexed for inflation in $100 steps.
- Box 10 of Form 1099-MISC (gross proceeds paid to an attorney) keeps its $600 floor because §6045(f) was not amended. Royalties in box 2 keep $10.
- The 2026 forms renumber boxes: nonemployee compensation moves to 1099-NEC box 1a, and new boxes report cash tips and overtime.
- Form 1099-K is separate: a card processor or payment app reports a payee only when payments exceed $20,000 and transactions exceed 200.
- Tax year 2026 forms are due in 2027: 1099-NEC by February 1; 1099-MISC by March 1 on paper or March 31 electronically.

## What the 1099 threshold is for 2026

The general reporting rule in IRC §6041(a) now reads “$2,000 or more in any calendar year.” Section 70433(a) of P.L. 119-21, signed July 4, 2025, substituted $2,000 for $600, effective for payments made after December 31, 2025. So a business that pays an independent contractor, a landlord or another non-corporate payee a total of $1,999 in 2026 does not file a Form 1099 for that payee. One that pays $2,000 does.

The IRS has carried the change into its forms. The 2026 Instructions for Forms 1099-MISC and 1099-NEC say that for tax years beginning after 2025 the minimum threshold for reporting certain payments increased to $2,000 and may be adjusted for inflation beginning in calendar year 2027. Box 1a of Form 1099-NEC and boxes 1, 3 and 6 of Form 1099-MISC each now read “$2,000 or more.”

A new §6041(h) indexes the amount. For any calendar year after 2026 the threshold rises with inflation from a 2025 base year, rounded to the nearest $100. The 2027 figure has not been published, so for the forms you prepare in early 2027 the number is simply $2,000.

## Which payments use $2,000, $600 or $10

Not every box moved. The $2,000 figure applies to payments reported under §6041: nonemployee compensation, rents, other income such as prizes and awards, and medical and health care payments. Two boxes keep their old floors because they come from other code sections, and one situation has no floor at all.

| Payment made in 2026 | Form and box | Threshold | Why |
| --- | --- | --- | --- |
| Nonemployee compensation (contractors, freelancers, a law firm’s fees for its services) | 1099-NEC box 1a | $2,000 | §6041(a) as amended |
| Rents | 1099-MISC box 1 | $2,000 | §6041(a) |
| Other income (prizes, awards) | 1099-MISC box 3 | $2,000 | §6041(a) |
| Medical and health care payments | 1099-MISC box 6 | $2,000 | §6041(a) |
| Gross proceeds paid to an attorney (settlement checks) | 1099-MISC box 10 | $600 | §6045(f), not amended |
| Royalties | 1099-MISC box 2 | $10 | unchanged |
| Any payment from which you withheld federal income tax | Box 4 of either form | any amount | backup withholding rule |
| Payments by credit card or payment app | 1099-K, filed by the processor | over $20,000 and over 200 transactions | §6050W(e) |

Attorney payments need care. Fees you pay a law firm for its own services are nonemployee compensation and go in 1099-NEC box 1a at $2,000. A settlement check or other gross proceeds paid to an attorney, where the lawyer is not the one earning the money, goes in 1099-MISC box 10 at $600. Both can apply to the same firm in the same year.

Payments to a corporation are generally exempt, but the instructions list exceptions that still require a form, including medical and health care payments and payments to attorneys. Check the exemption list in the instructions before you drop a corporate payee from the file.

## Backup withholding: a return at any amount

Publication 1099 (2026) makes the $2,000 figure the backup-withholding threshold too, but the amount does not matter once you have actually withheld. If you withheld federal income tax from a payee during 2026, you file a 1099 for that payee no matter how little you paid, and the tax goes in box 4.

Backup withholding is 24%. Publication 1281 says you must withhold when the payee does not give you a TIN, when the IRS notifies you that the TIN is incorrect (a B-notice), when the IRS notifies you that the payee underreported interest or dividends, or when the payee fails to certify that backup withholding does not apply. For nonemployee compensation and other non-interest payments, withholding starts immediately. A payee who refuses to give a TIN still gets a 1099; you withhold 24% and file anyway.

The way to avoid all of this is a signed Form W-9 (Rev. March 2024) before the first payment. [Collect W-9s electronically](https://fundtaxes.com/w9) and run every name and TIN through [IRS TIN Matching](https://fundtaxes.com/tin-matching) before you file, so a mismatch is fixed now rather than through a B-notice later.

## The 2026 box renumbering

The December 2026 revisions of both forms renumber boxes, so software maps and spreadsheets built for 2025 need updating. On Form 1099-NEC, nonemployee compensation moves from box 1 to **box 1a**. Box 1b is cash tips, box 1c is the Treasury Tipped Occupation Code (TTOC), and box 1d is overtime compensation. Box 2 is the direct-sales indicator for $5,000 or more of consumer products, box 3 is excess golden parachute payments, box 4 is federal income tax withheld, and boxes 5 to 7 are state boxes.

On Form 1099-MISC the familiar boxes keep their numbers: 1 rents, 2 royalties, 3 other income, 4 federal income tax withheld, 5 fishing boat proceeds, 6 medical and health care payments, 7 direct-sales indicator, 8 substitute payments, 9 crop insurance proceeds, 10 gross proceeds paid to an attorney, 11 fish purchased for resale and 12 §409A deferrals. New boxes 13a (cash tips), 13b (TTOC) and 14 (overtime compensation) follow, with box 15 for nonqualified deferred compensation and boxes 16 to 18 for state reporting.

## Form 1099-K is a different threshold

Form 1099-K is filed by payment settlement entities, not by the business making the payment. Under §6050W(e) as amended, a third-party settlement organization reports a payee only when gross payments exceed $20,000 _and_ the number of transactions exceeds 200. If you pay a contractor by credit card or through a payment app, you do not report that payment on a 1099-NEC or 1099-MISC; the processor reports it on Form 1099-K if the payee crosses both limits. Keep card payments out of your 1099 totals, or the contractor will be reported twice.

## Due dates for 2026 forms, filed in 2027

The statutory dates fall on weekends in 2027, so they roll to the next business day. January 31, 2027 is a Sunday, February 28, 2027 is a Sunday, and February 15, 2027 is Presidents’ Day.

| Form | To the recipient | To the IRS |
| --- | --- | --- |
| 1099-NEC | Monday, February 1, 2027 | Monday, February 1, 2027, paper or electronic |
| 1099-MISC | February 1, 2027; February 16, 2027 if box 8 or box 10 has an amount | Monday, March 1, 2027 on paper; Wednesday, March 31, 2027 electronically |

There is no automatic extension for Form 1099-NEC. An electronically filed return is timely if it is submitted through IRIS by 11:59 p.m. on the due date. Publication 509 for 2027 had not been published when this guide was written; the dates above are computed from the rule in the instructions.

The filing system is changing too. FIRE accepts its last filing on November 19, 2026 at 3 p.m. Eastern. From January 1, 2027, IRIS is the only IRS e-file system for information returns, including prior-year returns and corrections. The IRIS Taxpayer Portal takes manual entry of up to 100 forms per submission or a CSV upload of up to 250 forms per file, using only the IRS-provided templates.

## The e-file mandate and the penalties

If you file 10 or more information returns of any type during the year, counted together, you must file them electronically (T.D. 9972). A waiver is requested on Form 8508 at least 45 days before the due date.

Penalties under §6721 (the return) and §6722 (the payee statement) depend on how late you are. For returns required to be filed in 2027, Rev. Proc. 2025-32 sets these amounts:

| When corrected | Per return | Annual cap, receipts over $5 million | Annual cap, $5 million or less |
| --- | --- | --- | --- |
| Within 30 days of the due date | $60 | $698,500 | $244,500 |
| After 30 days, by August 1 | $130 | $2,095,500 | $698,500 |
| After August 1, or never filed | $340 | $4,191,500 | $1,397,000 |
| Intentional disregard | Greater of $690 or 10% of the amount | No cap | No cap |

The same tiers apply to the payee copy, so a form that is neither filed nor furnished can cost $680. “Small business” means average annual gross receipts of $5 million or less for the three prior years. For returns due in 2026 (tax year 2025) the tiers were $60, $130, $340 and $680 for intentional disregard.

Information-return penalties are not covered by [first-time abatement](https://fundtaxes.com/blog/first-time-penalty-abatement). Relief requires a written reasonable-cause statement under Reg. §301.6724-1 showing an event beyond your control, or significant mitigating factors, plus responsible conduct before and after the failure. Correcting within 30 days of discovering a problem is ordinarily treated as prompt. See [penalty relief for businesses](https://fundtaxes.com/penalty-relief).

## What to do before January

1. Pull every vendor paid in 2026 and total by payee. Exclude card and payment-app payments, and separate attorney fees (NEC 1a) from attorney gross proceeds (MISC 10).
2. Apply the thresholds: $2,000 for NEC 1a and MISC 1, 3 and 6; $600 for MISC 10; $10 for MISC 2; any amount where you withheld.
3. Get a W-9 from every payee at or over the threshold, and run TIN Matching on the file.
4. Count the forms. Ten or more across all types means e-filing, and after January 1, 2027 that means IRIS.
5. Calendar February 1, 2027 for 1099-NEC and March 31, 2027 for electronic 1099-MISC.

## Frequently asked questions

### What is the 1099 threshold for 2026?

$2,000. P.L. 119-21 amended IRC §6041(a) so that payments of $2,000 or more in a calendar year must be reported, effective for payments made after December 31, 2025. The $600 threshold applied through 2025.

### Is the 1099-NEC threshold $600 or $2,000 for 2026?

$2,000 for payments made in 2026. Box 1a of the 2026 Form 1099-NEC reads “$2,000 or more.” The $600 figure still applies to gross proceeds paid to an attorney, reported in box 10 of Form 1099-MISC.

### Does the $2,000 threshold apply to the 2025 forms filed in early 2026?

No. The change applies to payments made after December 31, 2025. Forms for 2025 payments used the $600 threshold; forms for 2026 payments, due in early 2027, use $2,000.

### What is the 1099-K threshold for 2026?

Under §6050W(e) as amended, a third-party settlement organization files Form 1099-K only when a payee’s gross payments exceed $20,000 and the number of transactions exceeds 200.

### Do I file a 1099 if I paid less than $2,000 but withheld backup withholding?

Yes. A return is required for anyone from whom you withheld federal income tax, regardless of the amount paid. Report the tax in box 4.

### Will the 1099 threshold change again?

Yes. New §6041(h) indexes the $2,000 amount for inflation for calendar years after 2026, using 2025 as the base year and rounding to the nearest $100. The 2027 figure has not been published.

### When are 2026 Forms 1099-NEC and 1099-MISC due?

1099-NEC is due to the IRS and recipients by February 1, 2027. 1099-MISC recipient copies are due February 1, 2027 (February 16 if box 8 or 10 is used); the IRS copy is due March 1, 2027 on paper or March 31, 2027 electronically.
